SEP 2 2192 F9 <br />-Mr. Williams noted that staff does not have a <br />recommendation, but would like direction from the 11Board. <br />Question arose as to whether the Variance Board can <br />consider this matter, and it was noted that the granting of <br />a variance is supposed to be for the purpose of alleviating <br />undue hardship. <br />Chairman Scurlock commented that the hardship cannot be <br />self-created. <br />Attorney Brandenburg informed the Board that there are <br />some very strict standards by which the Board of Adjustment <br />has to live, and he felt it is doubtful that this would meet <br />those standards. It was still his opinion, from a legal <br />point of view and considering the notice of claim that has <br />been filed, that, if it is a reasonable expenditure, the <br />Board should look at it very carefully and pursue all <br />avenues until they run into a dead end to avoid the <br />possibility of a claim of negligence. <br />Discussion continued as to what course the Board should <br />pursue. The Chairman summarized the Board's position, <br />noting that we have an option of proceeding with the <br />Variance Board, but if the variance is denied, we must find <br />some other space for Judge Stikelether andwill have to rent, <br />if we take the position of not requiring him to go back to <br />the Courthouse. <br />It was noted that there is no money in the budget for <br />any of this at the present time, and Commissioner Bird asked <br />if the County Courtroom is ready for occupancy. Commis- <br />sioner Fletcher believed they are still painting but that it <br />should be ready by Monday. <br />MOTION WAS MADE by Commissioner Fletcher, <br />SECONDED by Commissioner Bird, to instruct <br />Judge Stikelether to return to his old <br />quarters in the County Courthouse. <br />a-] <br />
