418/91 County(Legal)Ob <br />ORDINANCE NO. 91- 1L <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, <br />REGULATING THE WORK, CONSTRUCTION, AND PERMIT- <br />TED USE IN ALL COUNTY RIGHTS-OF-WAY EASEMENT <br />OR OTHER PUBLIC LANDS IN THE UNINCOPORATED <br />AREA OF INDIAN RIVER COUNTY, FLORIDA: PRO- <br />VIDING FOR TITLE_. PURPOSE: APPLICABILITY; <br />DEFINITIONS; EXEMPTIONS FROM PERMITTING; <br />PROHIBITED ACTIVITY; RIGHT-OF-WAY ORDINANCE <br />INFRACTION PROCEDURES; PERMIT APPLICATION <br />PROCEDURES; REPAIR OF DAMAGE TO COUNTY ROADS <br />OR RIGHTS-OF-WAY; UNPERMITTED CONSTRUCTION; <br />PERFORMANCE SECURITY; PERMIT EXEMPTION; <br />TERMINATION OF USE OR REMOVAL OF OBJECT; <br />PUBLIC PROTECTION AND LIABILITY; PENALTY; <br />REPEAL—GF- C-0NFL-I C -T I NG-PROV I S I ONS ;-iVC-0RPORTI ON <br />IN CODE; FEES; RIGHT-OF-WAY DRAWINGS; EFFEC- <br />TIVE DATE; AND SEVERABILITY, <br />WHEREAS, orderly administration and safety dictate <br />that the County regulate the use of County Rights-of-way, <br />NOW THEREFORE, BE IT ORDAINED by the Board of <br />County Commissioners of Indian River County, Florida, that: <br />SECTION 1. NEW CHAPTER. <br />Chapter 310 - Rights-of-way as set forth in Attachment <br />"A" to this Ordinance is hereby adopted. <br />SECTION 2. REPEAL OF CONFLICTING PROVISIONS. <br />All previous ordinances, resolutions, or motions of the <br />Board of County Commissioners of Indian River County, Florida <br />whi-ch-c-onfltc"i-th—th"r-ovisions of this ardimance are hereby <br />repealed to the extent of such conflict. All special acts of the <br />legislature applying only to the unincorporated portion of Indian <br />River County and which conflict with the provisions of this <br />ordinance are hereby repealed to the extent of such conflict. <br />SECTION 3.
