SOURCE SELECTION AND CONTRACT FORMATION <br />5.1 AUTHORITY TO CONTRACT FOR CONSTRUCTION SERVICES <br />The authority for contracting for construction services <br />is vested in the Board of County Commissioners, and <br />shall be exercised through the provisions of the <br />Procurement Code. <br />5.2 BONDS AND SECURITY REQUIREMENTS <br />A. BID SECURITY <br />1. As required by Section 105.04 - (c), (1) and <br />(2) Indian River County Code. <br />5.3 INSURANCE REQUIREMENTS <br />All contracts shall contain requirements for the <br />protection -ofthe County through suff3-c3-ent—insurance as <br />specified by the division of Risk Management. The form <br />of all such insurance certificates shall be approved by <br />Risk Management. Insurance requirements shall be <br />met, within approved time period prior to final award of <br />the bid -by the Board of County Commissioners. <br />5.4 INDEMNIFICATION <br />All contractors shall indemnify and save harmless the <br />County, its officers, agents and employees from any <br />injuries or damages received—by any person during any <br />operat-ions—connect—e witi�—the constr-uct-ion-r-o)!-ec-t, fry <br />use of any improper materials, or by any act or omission <br />of the Contractor or his subcontractor, agents, servants <br />or employees. <br />5.5 FORFEITING OF BONDS <br />All contracts for construction services shall contain a <br />clause allowing termination on default of the contractor <br />and providing that in such cases the surety company <br />shall bear the responsibility for the completion of the <br />contract, or if no surety—company <br />performance bond, the County may claim the alternate to <br />the performance and payment bond and use such funds for <br />the completion of the contract. <br />28 <br />SmeadSoft Reprint Date: Monday, August 12, 2013 - 15:25:22 - OfficialDocuments:674, Attachment Id 0, Page 35 <br />i <br />
