9/1601(Legal)DOCS(Ob) <br />ORDINANCE 91- 45 <br />--AN ORDINANCE OF I-NDIAN RIVER COUNTY, <br />FLORIDA, ESTABLISHING A GENERAL LIEN <br />PROVISION WHEN COUNTY. FUNDS -ARE <br />EXPENDED TO BRING ABOUT CONFORMITY WITH <br />THE INDIAN RIVER COUNTY CODE. <br />WHEREAS, from time to time the County takes remedial <br />action to assure compliance with the Code; and <br />WHEREAS, said action often results in the expenditure of <br />public funds; and <br />WHEREAS, logic and orderly. administration dictate that in <br />many situations the County . should be reimbursed for such' <br />expenditures; and <br />WHEREAS, a lien provision w assist <br />any reimbursemen ,• <br />W; -THEREFORE,- SK -,IT -ORDAINED -BY -THE -BOARD -Of <br />COUN7COMMISSIONERS-OF- mDIAN--RIVER-�-COUNTY FLORIDA, <br />SECTION 1. AMENDMENT. <br />section4o..o_ 9 is added -to -the -Code of Ordinance of <br />Tndian-River County to reader JOUGws; <br />ens Generally. <br />al . Unless specific lien provisions are provided* elsewhere in <br />this Code, whenever the County takes action under a provision <br />of this Code that results in the County expending funds to <br />accomplish -the specific act required or, co rmity with the <br />Code, the Board of County Commissioners may cause, by <br />Resolution, alien to be fileU n the OfficialRecord-Booksof- the <br />County against the owner of the property.or person responsible <br />or compliance with the Code for -the -costs -incurred -by <br />County. Notice of intent to adopt a -lien resolution shall .be <br />given to the -proposed- ienee Said -lienee -.may -appear -.before the <br />Commission and be heard on the proposed lien resolution. <br />b). The lien and notice provisions of Chapter 162, Florida <br />Statuteshall-pertain with -consequential changes -unless other . <br />notice has already been provided. <br />SECTION 2.
