3/18/91(Legal)Ob <br />ORDINANCE 91- 16 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA ESTABLISHING ADDITIONAL PRO- <br />CEDURES FOR THE PURCHASE OF REAL PRO- <br />PERTY BY THE COUNTY. <br />WHEREAS, Section 125.355, Florida Statutes, sets for the <br />procedures for the purchase of real property by counties; and <br />WHEREAS, said section provides for counties establishing <br />additional procedures; and <br />WHEREAS, the utilization of additional procedures could <br />provide the County with greater flexibility in the acquisition of real <br />property, <br />NOW; i`ITER1-FGRE, BE IT—GRDA3I+ED—B�Y--TiiE—B,&kR-D-0F <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />that: <br />SECTION 1. AMENDMENT. <br />A new section 102.11 is added to the Code of Ordinance of <br />Indian River County to read as follows: <br />Section 102.11 Purchase of Real Property <br />In addition to statutory methods and procedures for the purchase of <br />real property, the County may acquire real property by bid, <br />negotiated sale, or exchange. Where appropriate the County shall <br />establish the value of the property by appraisal. <br />SECTION 2. SEVERABILITY. <br />If any section, or if any sentence, paragraph, phrase, or <br />word of this ordinance is for any reason held to be unconstitutiona , <br />inoperative, or void, such holding shall not affect the remaining <br />portions of this ordinance, and it shall be construed to have been the <br />legislative intent to pass the ordinance without such unconstitutional, <br />SECTION 3.
