8/24/ 92 (d...) 1.a.1('CPO/ab) <br />1. <br />ORDINANCE 92-41 <br />ANORDINANC�E}FINDLANRIVER- BOUNTY, <br />FLORIDA, MAKING IT AN OFFENSE TO SCAVENGE <br />THE RECYCLABLE CONTENTS OF RECYCLING <br />BINS OR TO REMOVE SAID BINS. <br />WHEREAS, Indian River County has a recycling program; <br />and <br />WHEREAS, the success of the program is dependent, in <br />part, on revenue obtained from recyclable materials; and <br />WHEREAS, any diverting of recyclable materials to an <br />unauthorized source results in diminution of revenue to the County <br />and lessens the viability of the program, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA <br />that: <br />SECTION 1. AMENDMENT. <br />A new section 306.09 is added to read as follows: <br />Section 306.09. Scavenging recyclable materials. <br />No person other than the owner, owner's agent, a law <br />enforcement officer; an --Indian River— Count3—officer,—employee or <br />agent, or any person authorized by Indian River County shall remove <br />any of the recyclable contents from a recycling bin, remove the <br />recycling bin or engage in scavenging the recyclable contents of a <br />recycling bin. <br />SECTION 2. SEVERABILITY. <br />If any section, or any sentence, paragraph, phrase, or <br />word of this ordinance is for any reason held to be unconstitutional, <br />inoperative, or void, such holding shall not affect the remaining <br />portions of this ordinance, and it shall be construed to have been the <br />legislative intent to pass the ordinance without such unconstitutional, <br />invalid or inoperative part. <br />SECTION 3.
