N O V 17 1982 <br />BOOK <br />Mr. Lehman requested that the Board direct the Attorney <br />to draft a Clean Indoor Air Ordinance. <br />Wilson Wright, representing the Tobacco Institute, <br />believed that proprietors of restaurants would like to have <br />the freedom of choice to accommodate smokers and <br />non-smokers. He spoke about law enforcement if such an <br />ordinance were adopted, and he cited several cases. Mr. <br />Wright pointed out that litigation would be irritating and <br />time-consuming. He referred to various studies that had <br />been made concerning smoking, and second-hand smoke, and <br />felt that 860 of the carbon monoxide was caused by natural <br />sources. Mr. Wright concluded that every time a referendum <br />had been held to restrict smoking, it had failed; therefore, <br />he asked the Board to put this matter aside. <br />Ellis Pender, owner of Sabal Palm Bowl, approached the <br />Board and indicated that there was no way a bowling center <br />could enforce an ordinance of this type; it would put the <br />bowling industry out of business. He commented to the Board <br />that he was against any type of ordinance. <br />Bob Marshbanks, resident of Vero Beach, came before the <br />Boa -rd and commented that this was like a prohibition . — He <br />felt it should be a voter's issue. Mr. Marshbanks added <br />that there was such a thing as common courtesy and respect, <br />and he would honor a "no smoking" sign. <br />Attorney Brandenburg advised that the purpose was to <br />establish a standard concerning this issue, and not to <br />create a situation where law enforcement officers would have <br />to go through proprietors' places. <br />Commissioner Bird reported that he spoke with Mr. <br />Norton of the Chamber of Commerce, and he would like to take <br />this matter up with the leaders of his organization. <br />Motion was made by Commissioner Fletcher that the Board <br />grant a public hearing for an ordinance on this subject. <br />
