justification for their issuance, and submit a copy annually to <br />the Federal Insurance Administrator. <br />(7) Interpret the boundaries of Critical Flood Zones, <br />Flood Hazards Zone and Flood Protection Elevations and interpret <br />the boundaries drawn on the Official Flood Hazard Boundary Map to <br />reconcile elevation data and field conditions. <br />(8) Issue notice of violation and otherwise enforce <br />this ordinance. <br />SECTION 12. APPEAL PROCEDURE <br />A. Duties of the Board of Adjustments - The Board of <br />Adjustments shall have the following duties in administering this <br />ordinance: <br />(1) Upon appeal by the developer, review decisions of <br />the Community Development Director regarding interpretations of <br />-this=-ordinance, providing the appeal is filed in writing within <br />thirty (30) days of the action which is appealed. <br />(2) Issue variances from the standards of this <br />ordinance when all variance criteria are met. <br />B. Variance - The Board of Adjustments may grant a <br />variance from the standards of this ordinance if the following <br />conditions are satisfied: <br />(1) The applicant meets the requirements of Section 26 <br />of the Indian River County Zoning Code, and <br />(2) Granting a variance will not result in an increase <br />in the elevation of the Regulatory Flood, additional threats to <br />public safety, extraordinary public expense, the creation of <br />nuisances, fraud or victimization of the public, or the creation <br />of conflicts with other local ordinances, and <br />(3) No variance will be granted allowing a development <br />that would increase flood damage on other property unless flowage <br />easements have been obtained from the owners of all affected <br />property. In no case, however, will a variance be granted that <br />would increase the elevation of the Regulatory Flood more than one <br />foot. <br />Any applicant to whom a variance is granted shall be <br />given written notice specifying the exact nature of the variance. <br />-26- BOK PAGE P7 <br />NOV 17 1982 <br />
