Henders, <br />dated September 7, 1982. <br />It is requested that the data herein presented be given <br />formal consideration by the Board of County Commissioners. <br />DESCRIPTION & CONDITIONS: <br />On July 22, 1982, Mr. Richard Van Slyke, representing Florida <br />Land Company, submitted an application for site plan approval <br />to revise the previously approved River Bend project. Th(, <br />initial phase of the development consists of 116 dewelliu& <br />units located on a 38.3 acre tract'of.land situated to the <br />west of Highway A -1-A. <br />In April of 1982, the Planning and Zoning Commission approved <br />the site plan for the entire River Bend. project . - This action w. <br />taken prior to the adoption of the Thoroughfare Plan, however, <br />the Plan was approved by the Board of County Commissioners in <br />January of 1982. The Plan designates Highway A -1-A as av <br />arterial, potentially requiring 120' of right-Qf-way. 'Trite <br />.Department of Transportat-i.on, undet- Florida Statues 163..!'`,O, <br />completely endorses the projected right-o'f-way needs for <br />this State Road. One hundred feet of right-of-way exists in <br />the area of the River Bend project. At the time of the <br />original site plan approval the developer did not dedicate the <br />additional right-of-way specified by the Plan. Due to the <br />design of the proposed development the structural setbact: = <br />adequately satisfied this requirement. <br />The subsequent site plan submitter to revise the initial. T-1hase <br />of the project now proposes a 6' high, 2-1/2' vide, -1conex-p-te <br />block wall to be cons true ted , at varying points, on ithe z L ght- <br />of-way' line. This proposal does not conform to the Thorniigh- <br />fare Element of Indian River County's. adopted Comprehensive <br />Plan. <br />On August 26 , 1982, the Planning and Zoning Commission approved <br />the site plan application with the condition that an additional <br />10' be provided for right-of-way. This condition can be <br />accomodated by the relocation of the proposed wall to 10' west <br />of the existing right-of-way lino. <br />RECOMMENDATION: <br />It is the Planning Staff's recommendation that the appeal of <br />the condition of site plan approval for the River Bend project <br />be denied; based on non-conformance with the Comprehensive Plan. <br />D E C 11982 15 <br />LL - <br />
