V <br />A brief discussion followed. <br />Norman Mead, Attorney from Jensen Beach representing <br />Hutchinson Utilities, Inc., approached the Board and advised <br />that there had been a lawsuit filed regarding Harborside <br />Development and Hutchinson Utilities, Inc. He continued <br />that the lawsuit did contain elements which Mr. Kramer <br />brought out and they strictly opposed any determination of <br />the Board pending the outcome of the lawsuit. Attorney Mead <br />suggested they await the resolution of the lawsuit; they <br />felt the Complaint was a smoke screen to get two days in <br />court instead of one. <br />Commissioner Fletcher asked if his client felt it owned <br />the system. <br />Attorney Mead responded there was no question about it, <br />and The Moorings also had no question as to who owned the <br />plant. He stated it was done around August 19th when the <br />Board granted the franchise. <br />Dorothy Hudson, Attorney for The Moorings, came before <br />the Board affirmed that the transfer had occurred under the <br />guidance of the Board and in concurrence with the property <br />owners. She felt it was properly done. <br />Sam White, President of the Property Owners of The <br />Moorings, approached the Board and commented that they did <br />have an issue of the rate problem. He felt they were paying <br />twice what Johns Island residents are paying. Mr. White <br />emphasized that audited financial statements were needed.to <br />know how Hutchinson was allocating their costs. He urged <br />the Board to look into this matter. <br />Attorney Kramer suggested that the Board have a <br />committee selected consisting of a County consultant, and <br />representatives of The Moorings and Hutchinson Utilities, <br />Inc., and have them meet and examine the files and financial <br />statements. <br />46 <br />
