REQUEST TO REZONE ± 125.83 <br />ACRE PARCEL FROM C-1, COMMERCIAL <br />AND R-lA, SINGLE FAMILY TO R2D,• <br />MULTIPLE FAMILY <br />REFERENCES: <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on December 1, 1982. <br />DESCRIPTION AND CONDITIONS: <br />On October 14, 1982, the Planning and Zoning Commission voted <br />'c—4�-to-0 to recommend denial of the request to rezone a ± 125.83 <br />acre parcel•located between U.S.#1 and the Indian River, just <br />south of 12th Place from C-1, Commercial and R-lA, Single <br />Family (maximum 4.3 units/acre) to R2D,. Multiple -Family (maximum <br />of 6 units/acre). The Planning and Zoning Commission denied the <br />request to rezone because the proposed multi -family development <br />would conflict with the existing character of the single family <br />uses in the area. Subsequently, on October 22, 1982, the ap- <br />plicant submitted an appeal of the Planning and Zoning Commission <br />denial of the application. The applicant waived his right to <br />a 30 day notice prior to the public hearing for his rezoning. <br />-The subject property is located directly south of River Shores <br />Subdivision and lies between U.S.#1 and the Indian River. The <br />subject property is designated LD2, Low Density Residential <br />(maximum of 6 units/acre). The subje&t property contains ± 31.38 <br />acres along the Indian River which are designated as Environmentally <br />Sensitive. The applicant has applied for a Binding Letter of <br />Interpretation (form BLWM-01-81) from the Department of Community <br />Affairs.' <br />ALTERNATIVES AND ANALYSIS: <br />Environment - The rectangular shaped parcel has approximately <br />1,213 feet of frontage on U.S.#1, with the east/west boundaries <br />extending approximately 4,100 feet to the Indian River. The <br />subject property contains ± 7.0 acres of submerged land, 24.38 <br />acres of Environmentally Sensitive locateiT east of the dike, <br />and ± 94.45 acres which are in productive groves and natural <br />vegetation. These three areas will be discussed .in terms of <br />the impact of the proposed development on each of these segments. <br />The environmental analysis will cover a vegetative survey, <br />drainage considerations, flood hazard classification, the Indian <br />River and its impacts, and administrative status of the area. <br />Vegetation - The Environmentally Sensitive area west of the dikes <br />con ns play. communities of Spartina, Jankus, and other shrubs <br />associated with tidal area plant communities: Mangroves grow <br />along the eastern boundary of the Environmentally Sensitive area. <br />A few scattered mangroves are also located along the D.O.T. ditch <br />line north of the subject property.
