.ORDINANCE NO. 2009- 020 <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA <br />EXTENDING THE DEADLINE BY THREE YEARS FOR <br />PLANNED DEVELOPMENTS TO COMMENCE CONSTRUCTION <br />OR HAVE THEIR ZONING REVERT TO THE SITE'S ORIGINAL <br />(PRE -PLANNED DEVELOPMENT APPROVAL) ZONING; AND <br />PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners of Indian River County <br />has approved four (4) Planned Development projects and included within those <br />approvals is a requirement that the Planned Development zoning approval <br />sunset if project construction did not commence by a certain date; and <br />WHEREAS, due to current economic conditions the Board finds that it is <br />reasonable to extend those deadlines for an additional three years; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that the zoning <br />reverter deadlines for construction commencement of the following planned <br />developments be extended for three years: <br />Liberty Park PD to October 14, 2018 [revises Ordinance No. 2008-017] <br />Mandala Club PD to May 17, 2011 [revises Ordinance No. 2005-016] <br />Turtle Creek Preserve PD to April 4, 2014 [revises Ordinance No. 2006-0091 <br />Sunnyside Up PD to January 20, 2022 [revises Ordinance No. 2009-0011 <br />EFFECTIVE DATE. <br />This ordinance shall take effect upon filing with the Florida Department of <br />State. <br />This ordinance was advertised in the Vero Beach Press -Journal on the <br />26thday of October, , 2009, for a public hearing to be held on the 10th day <br />of November, 2009,.at which time it was moved for adoption by Commissioner <br />F1 escher , seconded by Commissioner 0'l3r-y9;�—' and adopted <br />by the following vote: <br />Wesley S.
