D E C 15 1992 r;6423 <br />TO: The Honorable Members CRATE: December 6, :1 82 FILE: <br />of the Board of County <br />Commissioners <br />TO <br />SU,r3jE7�`�'PROPOSED REGULATION SRE: 5DMIM,TC ? <br />AErUPDIVISION AGRICULTURT. <br />SUBDIVISION <br />R�' //p. <br />PO: Bruce King, ����% R IE: FERIE KI%C; S: <br />Community Development <br />Division Director <br />It is requested that the information provided herein be given <br />formal consideration by the Board of County Commissioners <br />during their regular meeting of December 15, 1982. <br />DESCRIPTION* AND COTyD:I'�`TOl�S <br />On October 5, 1982, the County received a letter from <br />Mr. Dan Richardson of Gracewood, Inc. requesting that the <br />current subdivision ordinance be amended to allow <br />agricultural property to be subdivided into 5 acre <br />lots without the installation of paved streets. <br />The specific piece of property involved in Mr. Richardson's <br />proposal is an 880 acre grove on the corner of Ranch Road <br />and North Winter Beach Road. This grove has been on the <br />market for sale and has received interest from a number of <br />people in buying part of this property in small acreages. <br />It is Mr. Richardson's intention that this particular grove <br />lends itself very readily to being divided into parcels of <br />5 acre groves and larger due to the adequate provision for <br />drainage on all grove parcels and adequate ingress and egress <br />upon all of the established dirt roads. <br />However, according to the current requirements of the <br />County's subdivision ordinance, wherever any land within <br />the County i.s platted into lots and such platting provides <br />for the establishment or extension of streets, alleys or <br />other rights-of-way, a plat thereof shall be recorded in- —. <br />the public records of Indian River County. Furthermore after <br />such provision, all of the lots shall border upon an existing <br />street or public road with a minimum lot width conforming to <br />the requirements of the specific zoning district. In addition, <br />the current subdivision regulations require the installation <br />of paved streets with a minimum pavement width of 20' exclusive <br />of curbs. <br />ALTERNATIVES AND ANALYSIS: <br />In Mr. Richardson's letter dated October 4, 1982, he presented <br />his intent to create a private subdivision and the establishment <br />of a Property Owners' Association to be responsible for the <br />maintenance of private roads and canals. Such a private street <br />network encompassing 880 acres could create a physical barrier <br />within the co,amunit_y.to obstruct public traffic and efficient <br />traffic flows. It is important that all subdivisions, both <br />public"and private, conform to the transportation element of <br />the County's Comprehensive Plan and provide the necessary public <br />right -of: -way. <br />Historically, one of the pri.mnry purposes of the subdivision <br />Platting process was to ensure that adequate infrastructure <br />was installed prior to the actutal utilization of the land for <br />urban uses. Final ,plat approval without the necessary infra -- <br />structure may result: in future demand for such improvements. <br />As you may recall, Lhore have recently been several articles <br />103 <br />
