ORDINANCE NO. 2012-007 <br />u Signatory requirements for control authority reports. Reports submitted to the FDEP by the <br />control authority must be signed by a principal executive officer, ranking elected official, or other duly <br />authorized employee. The duly authorized employee must be an individual or position having <br />responsibility for the overall operation of the wastewater facility or the pretreatment program. This <br />authorization must be made in writing by the principal executive officer or ranking elected official, and <br />submitted to the FDEP prior to or together with the report being submitted. <br />(H) Provisions governing fraud and false statements. Any person, including a responsible corporate <br />officer, submitting or maintaining reports and other documents required under this chapter shall be <br />subject to the civil and criminal penalties of Section 403.161, F.S., for any falsification described in that <br />section. <br />ll Record-keeping requirements. <br />ll Any industrial user and control authority subject to the reporting requirements established in this <br />chapter shall maintain records of all information resulting from any monitoring activities required by this <br />chapter, including documentation associated with Best Management Practices. All sampling and <br />analysis activities shall be subiect to the record-keeping requirements specified in Chapter 62-160, F.A.C. <br />(2) Any industrial user or control authority subiect to the reporting requirements established in this <br />chapter, including documentation associated with Best Management Practices , shall be required to <br />retain for a minimum of 3 years any records of monitoring activities and results (whether or not such <br />monitoring activities are required by this chapter) and shall make such records available for inspection <br />and copying by the FDEP (and control authority in the case of an industrial user). This period of <br />retention shall be extended during the course of any unresolved litigation regarding the industrial user <br />or control authority. <br />(3) Any control authority to which reports are submitted by an industrial user shall retain such reports <br />for a minimum of 3 years and shall make such reports available for inspection and copying by the FDEP. <br />This period of retention shall be extended during the course of any unresolved litigation regarding the <br />discharge of pollutants by the industrial user or the operation of the pretreatment program. <br />(4) The control authority must retain documentation to support the control authority's determination <br />that a specific industrial user qualifies for reduced reporting requirements for a period of 3 years after <br />the expiration of the term of the control mechanism. <br />k64u Permit decisions. The county administrator will evaluate the data furnished by the user and may <br />require additional information. Within thirty (30) days of receipt of a complete wastewater discharge <br />permit application, the county administrator will determine whether or not to issue a wastewater <br />discharge permit.
