ORDINANCE NO. 2012-007 <br />violation of this part, or that there is a need to inspect and/or sample as part of a routine inspection and <br />sampling program of the county designed to verify compliance with this part or any permit or order <br />issued hereunder, or to protect the overall public health, safety and welfare of the community, then the <br />county administrator may seek issuance of a search warrant, or, where applicable, an inspection <br />warrant, all pursuant to Florida Statutes Chapter 933, Search And Inspection Warrants_ <br />Section 201.81. Confidential information. <br />Information and data on a user from reports, surveys, wastewater discharge permits, and monitoring <br />programs, and from the county administrator's inspection and sampling activities, shall be available to <br />the public without restriction, unless the user specifically requests, and is able to demonstrate to the <br />satisfaction of the county administrator, that the release of such information or data will compromise <br />the user's trade secrets. When requested and demonstrated by the user furnishing a report that such <br />information should be held confidential, the portions of a report which might disclose trade secrets or <br />secret processes shall not be made available for inspection by the public (subject to the applicable <br />provisions of the Florida Public Records Law), but shall be made available immediately upon request to <br />government agencies for uses related to the NPDES program or pretreatment program, and in <br />enforcement proceedings involving the person furnishing the report. Wastewater constituents and <br />characteristics and other effluent data as defined by 40 CFR 2.302 will not be recognized as confidential <br />information and will be available to the public without restriction. <br />Section 201.82. Publication of users in significant noncompliance. <br />(A) The county administrator shall publish annually, in the largest daily newspaper circulated in the <br />county, a list of users that, during the previous twelve (12) months, were in significant noncompliance <br />with applicable pretreatment standards and requirements. <br />(B) The term significant noncompliance shall mean: <br />(1) Chronic violations of wastewater discharge limits, defined here as those in which sixty-six (66) <br />percent or more of wastewater measurements taken for the same pollutant parameter taken during a <br />six- (6) month period exceed (by any magnitude) a numeric Pretreatment Standard or Requirement, <br />including Instantaneous Limits as defined in Section 201.68 <br />(2) Technical Review Criteria (TRC) violations, defined here as those in which thirty-three (33) <br />percent or more of wastewater measurements taken for each pollutant parameter during a six (6) <br />month period equals or exceeds the product of the numeric Pretreatment Standard or Requirement <br />including Instantaneous Limits, as defined by Section 201.68, <br />multiplied by the applicable criteria (1.4 for BOD, TSS, fats, oils, and grease, and 1.2 for all other <br />pollutants except pH); <br />Coding: Words/letters/numbers underlined are additions to text; words/letters/numbers in <br />strikethFeUgI4 format are deletions to text. <br />34 <br />
