ORDINANCE NO. 2013- 009 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND ZONING MAP BY REZONING ±2.16 ACRES FROM IL, <br />LIGHT INDUSTRIAL DISTRICT, TO RM -10, MULTI -FAMILY RESIDENTIAL <br />DISTRICT (UP TO 10 UNITS/ACRE) (southern property); AND SIMULTANEOUSLY <br />REZONING ±2.16 ACRES FROM RM -10 TO IL (northern property). AND PROVIDING <br />CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency <br />on such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; and <br />WHEREAS, the Board of County Commissioners determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida, that the zoning of the following described property situated in <br />Indian River County, Florida, to -wit: <br />Southern Property. <br />COMMENCING AT THE SOUTHWEST CORNER OF SECTION 23, TOWNSHIP 32 SOUTH, <br />RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA; THENCE EASTERLY ALONG THE <br />SOUTH BOUNDARY LINE OF SAID SECTION 23, A DISTANCE OF 790.8 FEET TO THE POINT <br />OF BEGINNING OF THE LAND BEING CONVEYED; THENCE RUN EAST ALONG THE SOUTH <br />BOUNDARY LINE OF SAID SECTION 23, TO A POINT ON THE SAID SOUTH BOUNDARY <br />LINE THAT IS 225 FEET WEST OF THE WEST RIGHT-OF-WAY LINE OF THE FLORIDA EAST <br />COAST RAILWAY; THENCE NORTH 225 FEET; THENCE RUN EAST TO THE WEST RIGHT- <br />OF-WAY LINE OF THE FLORIDA EAST COAST RAILWAY; THENCE RUN IN A NORTHERLY <br />DIRECTION ALONG THE WEST RIGHT-OF-WAY LINE OF SAID FEC RAILWAY TO A POINT <br />WHERE THE NORTH BOUNDARY LINE OF THE SOUTHWEST QUARTER OF THE <br />Paee 1 of 3 <br />
