As you know, the Board <br />previously has not been involved directly in the lot clearing process. <br />However, the Cmmmnity Development Division staff was advised by the <br />County Attorney's Office that our current operations in regards to lot <br />clearings did not comply with the current ordinance requirements. <br />Therefore, operational changes were implemented to bring the lot <br />.---Clearing process under compliance. <br />Under Chapter 13, the Board of County Commissioners is authorized and <br />empowered by resolution to require lands within the unincorporated area <br />of the County. to be cleared of weeds, debris, and any noxious material <br />which tend to be a breeding place or haven for snakes and vermin or <br />which tend to create a fire or traffic hazard or which to tend to create <br />a nuisance or other unsightly or unsanitary condition provided that the <br />land in question is located within 150 feet of a road intersection or <br />within 200 feet of the nearest inhabited dwelling unit. In compliance <br />with this Chapter, it is necessary for the Board of County Commissioners <br />to declare each and every lot to be cleared under said Chapter a public <br />nuisance and to direct staff to transmit written notification of such <br />declaration to the property owner and further notify the property owner <br />that his land must be cleared in accordance with Chapter 13. <br />In an effort to simplify and expedite this process, a standard <br />resolution was drafted by the County Attorney's Office which will <br />accommodate any number of necessary lot clearings. Therefore, in the <br />Alternatives and Analysis section of each lot clearing agenda item, a <br />specific description of the existing conditions for each lot will be <br />Presented as well as a staff recommendation as to whether or not the at <br />in question is creating a public nuisance. It is the intend of the <br />staff recommendation to minimize the unnecessary clearings of land <br />which do not create a public nuisance. <br />The criteria utilized in determining when a particular lot should be <br />recommended for clearance is as follows: <br />1) If a lot contains weeds or other materials which obstruct visibility <br />at a road intersection <br />2) If a lot contains weeds, debris, or other noxious material at a <br />minimum 24 inches in height and said lot is located in an area where the <br />surrounding lots are at a minimum 50% developed <br />3) In areas where development is less than 50% completed, if the lot <br />contains weeds, debris or other noxious material which at a minimum is <br />24 inches in height and also exemplifies a direct, mediate threat to <br />the public health, safety or welfare. <br />17 <br />
