will continue in effect through the term of the contract, <br />and he would recommend that if the Commission enters into <br />the contract that a copy of the contract be sent to the <br />insurer with the specific request that they send the Board a <br />letter certifying that the policy in effect will continue <br />through the term of the contract. With respect to the <br />second item, he has talked with Judge Stikelether, and <br />although the Judge is of the opinion that it is somewhat of <br />a circuitous way to reach a result, he agrees that if <br />individual members of the Bar were appointed, it would cost <br />the County more in the long run and indicated that he will <br />continue appointing the Public Defender's office. <br />Administrator Wright submitted that we have a 30 day <br />severance clause; that this is the least expensive way out; <br />and recommended that we go ahead with this proposal and then <br />get together with other County officials at the SACC meeting <br />to see what can be done about this problem. <br />MOTION was made by Commissioner Scurlock, SECONDED <br />by Commissioner Lyons, to accept the recommendation <br />of the Administrator and authorize the Chairman to <br />sign the contract proposed by the Public Defender's <br />Office, contingent on receiving a letter from <br />the insurance company certifying the malpractice <br />insurance coverage and also contingent upon having a <br />termination provision in the contract. <br />Commissioner Wodtke continued to discuss the lack of <br />money in the budget for this purpose; he believed what will <br />happen is that we will have to do without something we need <br />in order to do this. <br />Commissioner Scurlock discussed going along with this <br />on a 30 day basis and adopting a Resolution to be conveyed <br />to the appropriate people identifying the situation and our <br />87 <br />JAN 1983 <br />
