TO: The Honorable Members of the DATE: January 4, 1983 FILE: <br />Board of County Commissioners <br />Through: Michael Wright, ✓ <br />County Administrator <br />SUBJECT: Final Payment - Indian River county <br />Jail Security Fencing <br />FROM: Jim Davt <br />' <br />Public Director REFERENCES: <br />DESCRIPTION AM CONDITIONS <br />The Security Fencing installation at the County Jail is complete. The original <br />contract between Indian River County and Martin Fence Company dated August 4, 1982 <br />defined the project cost at $18,250. The original time of completion was October <br />12, 1982. A partial payment in the amount of $13,961.25 was issued in December, <br />1982. The outstanding contract balance is $4,288.75. <br />ALTERNATIVES AMID ANALYSIS <br />The Ja l Administrator, Bill Baird, and the Public Works Director have inspected <br />the work and find the materials and installation to substantially conform to the <br />contract documents. Due to delay of equipment shipments and work performed by <br />other contractors, the 49 days that the contractor exceeded the 30 day time of <br />impletion Is justified. The work was substantially cOMPlete on December 1, 1982, <br />and the one year warranty period commenced on December 1, 1982. <br />The contractor has submitted subcontractor affidavits and release of lien forms; <br />however, the contractor has shown that payment to subcontractors, Paul White <br />Electric in the amount of $572.52 and to T.P.A., Inc. in the amount of $2112.56, <br />is still outstanding. The County Attorney's office has no objection to the <br />issuance of 3 checks as follows: <br />1) One check payable to Martin Fend Co. and Paul White Electric, Inc. <br />in the amount of $572.52. <br />2) One check payable to Martin Fence Co. and T.P.A., Inc. in the amount <br />of $2112.56. <br />3) One check payable to Martin Fence Co. in the amount of $1603.67. <br />XXT4 MATIONS AND FUNDING <br />It is recommended that: <br />1) Project No. 8122 - Indian River County Jail Improvements - Bid Item No. 3 - <br />Security Fencing - Martin Fence Co. - be accepted as complete as of <br />December 1, 1982. <br />2) Final payment be made in the amount of .$4,288.75 by issuance of three <br />separate checks as follows: <br />1) Martin Fence Co. and Paul White Electric, Inc. — $572.52 <br />2) Martin Fence Co. and T.P.A., Inc. $2112.56 <br />3) Martin. Fence Co. - $1603.67 <br />3) A time extension be granted of 49 days to the original completion date of <br />October 12, 1982, and that liquidated damages be waived. <br />22 <br />('OK C9, PAVE. <br />
