ORDINANCE 2012-036 <br />(7) Interpretation In the interpretation and application of these floodplain <br />regulations, all provisions shall be: <br />1. Considered as minimum requirements; and <br />2. Deemed neither to limit nor repeal any powers granted under state statutes. <br />Section 930.04. Definitions. <br />Refer to Chapter 901 of this code for definitions applicable to stormwater management <br />and flood protection. <br />Section 930.05. Prohibited activity. <br />(1) It shall be illegal and subject to the penalties provided herein for any person to <br />construct, or arrange for, authorize, or participate in the construction of a development project <br />within the unincorporated area of Indian River County without first obtaining a valid permit to <br />construct either a stormwater management system (hereinafter referred to as a Type A permit), a <br />flood protection-stormwater management system, when applicable, (hereinafter referred to as a <br />Type B permit), or a flood management system when applicable, (hereinafter referred to as a <br />Type "C" Permit), when apphea''te-, pursuant to this chapter. <br />(2) It shall be illegal and subject to the penalties provided herein for any person to <br />construct anv structure and/or alter any stizue4ffe property in such a mamler as to impede the <br />functioning of a drainage system that is: <br />(a) Publicly maintained or; <br />(b) Located on private property and is a part of a drainage system serving more than <br />one (1) property owner when such system is le :_a in an easemeH4 Whie>7 exists <br />for the benefit of other land owners or has historically provided drainage. <br />(3) It shall be illegal and subject to the penalties provided herein for anv person, - <br />corporation or association responsible for maintenance of a drainage system or component of a <br />drainage system to fail to maintain that system or component of a drainage system that is: <br />(a) Publicly maintained or; <br />(b) Located on private property and is apart of a drainage system serving more than <br />one (1) property owner when such system exists for the benefit of other land <br />owners or has historically provided drainage. <br />(4) Unless otherwise permitted, it shall be illegal and subject to the penalties provided <br />herein for any person to discharge any fluid discharge from a washing machine or any <br />Underline: Additions to Ordinance <br />Stfil£e-threagk.
