Short title; statutory authority; applicability. <br />(1) This chapter shall be known and maybe cited as the Indian River County Correctional Facilities Impact <br />Fee Ordinance. <br />(2) This chapter shall apply to the entire county, including the municipalities within the county, to the extent <br />permitted by Article VIII, sec 1(f), Florida Constitution. <br />(Ord. No. 2005-015, 5-17-05) <br />Section 1003.02. Findings. <br />In addition to those findings and determinations found in Chapter 1000, the board of county <br />commissioners makes the following findings and determinations: <br />(1) The existing correctional facilities are not sufficient to accommodate anticipated new development <br />without decreasing the existing levels of service. <br />(2) Generally, a€xisting revenue sources are not sufficient to fund capital improvements necessary <br />to accommodate new developments however, consistent with the findings of the Indian River <br />County Impact Fee Update Study Final Report dated September 26, 2014, the board has <br />determined to not use impact fees as a revenue source for correctional facilities - <br />(3) For impact fee calculation purposes, tThe correctional facilities level of service standard for the <br />county is fauraand- ene-half (4.50) inmate bed6 per one thou6and (1,000) PeFrnanent plu6 weighted <br />$186 per functional resident for additional capital assets. <br />(Ord.
