Notice to this individual to correct the situation or demolish <br />same was last attempted on December 14, 1982, but was returned <br />"Addressee Unknown." Diligent search and inquiry by the <br />Planning & Zoning Department has not produced any better <br />information as to the present whereabouts of this owner. The <br />property has been duly posted. Notice of this meeting has also <br />been mailed to the last known address of the owner. <br />Recommended Action -- It is this office'.s opinion that all <br />ordinance prerequisites have been satisfied with respect to <br />this property and that the Board may take action if it desires <br />to: <br />(a) Cause demolition of this structure immediately (or after a <br />grace period if deemed appropriate); and <br />(b) Authorize the filing of a lien against this property for <br />all costs incurred with respect to the demolition. <br />2. HIGHLANDS MOTEL located on North U. S. 1 near Sebastian, <br />Florida, Parcel Control #17-3I-39-000-3000-014.0, apparent <br />owner of record, Dr. Charles A. Fenner, 3000 North A -1-A, <br />Indialantic, Florida 32903. <br />Located on this well known premises are three motel buildings, <br />a swimming pool, and a storage building. The attached <br />inspection report describes the condition of this property as <br />of the end of January, 1983. All notices required by Chapter 4 <br />of the Code of Laws and Ordinances have been delivered or <br />attempts to do so have been made which have been frustrated by <br />Dr. Fenner. One such certified notice was recently accepted by <br />Mrs. Mary Sue Fenner for her husband, but same was returned <br />unopened several days later in the mail marked "Refused." The <br />property has been duly posted and the owner has, in addition, <br />been.notified of this meeting by telephone communication and <br />certified mail. <br />You may recall that past County attempts to demolish this <br />property resulted in the filing of a 1981 Federal Court action <br />against the County by Dr. Fenner. This lawsuit was voluntarily <br />dismissed by Dr. Fenner's attorney who no longer represents Dr. <br />Fenner and has no desire to reinitiate said proceeding. The <br />County has received no guaranty directly from Dr. Fenner that <br />he would not retain another attorney to pursue his cause, but <br />it is not felt likely that he has a legitimate basis for doing <br />so. <br />Recommended Action - It is this office's opinion that all <br />ordinance prerequisites have been satisfied with respect to <br />this property and that the Board may take action if it desires <br />to: <br />(a) Cause demolition of these structures immediately (or after <br />a grace period as deemed appropriate); and <br />(b) Authorize the filing of a lien against this property for <br />all costs incurred with respect to the demolition. <br />
