Fenner <br />Chris Paullreviewedthe extensive past history per- <br />taining to demolition of the Highlands Motel, which is owned <br />by Dr. Charles A. Fenner. He recommended the County proceed <br />with the demolition of this property and advised that proper <br />notice had been given to satisfy the ordinance requirements <br />as evidenced by the following affidavit: <br />State of Florida <br />County of Indian River <br />AFFIDAVIT AS TO NOTICE <br />BEFORE ME, the undersigned authority personally appeared <br />CHRISTOPHER J. PAULL who was sworn and says: <br />1. I am the Assistant County Attorney for Indian River <br />County, Florida and in the course of my duties have been attempt- <br />ing to deliver notification.to.Dr. Charles A. Fenner regarding the <br />County Commission's consideration of whether to demolish a certain <br />property known as the Highlands Motel and Pool, located on North <br />U. S. #1 in Indian -River County. <br />2. On or about February 8, 1983, I spoke personally by, <br />telephone communication with Mrs.:Mary Sue Fenner, who identified - <br />herself as the wife of Dr. Charles Fenner, and at that time I <br />advised her that the County Commission would be considering this <br />matter again, as it had in the past. <br />3. Mrs. Fenner acknowledged that she would attempt to <br />relay my message to her husband at her earliest convenience. <br />4. Mrs. Fenner further acknowledged that she would <br />receive certified mail notice' -of this matter upon its delivery to <br />their address, which she identified as 3000 North A -1-A, <br />Indialantic, Florida 32903. Such notice was mailed from this <br />office: on February 9, 1983, by certified mail to the afore- <br />mentioned address. <br />5. Following my conversation with Mrs. Fenner, and <br />prior to this date, I have further attempted to contact and <br />deliver personal notice to Dr. Fenner by telephone and have left <br />such notice on at least three (3) separate occasions by message on <br />Dr. Fenner's telephone recording device, at the same telephone <br />number at which I had spoken with Mrs. Fenner on February 8th <br />(305-723-7041). <br />FURTHER AFFIANT SAYETH NOT. <br />CHRISTOPHER J.
