ORDINANCE NO. 2010- 004 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE FUTURE <br />LAND USE MAP BY CHANGING THE LAND USE DESIGNATION FOR: <br />A. APPROXIMATELY ± 27.97 ACRES, LOCATED AT 9700 WATER VLIET AVENUE <br />SEBASTIAN, FROM L-1, LOW-DENSITY RESIDENTIAL -1 DISTRICT (UP TO 3 <br />UNITS/ACRE), AND C/I, COMMERCIAL / INDUSTRIAL DISTRICT, TO C-1, <br />CONSERVATION -1 DISTRICT (0 UNITS/ACRE); AND <br />B. APPROXIMATELY ± 37.48 ACRES, LOCATED AT 7775 AND 7780 85th STREET <br />VERO BEACH, FROM AG -1, AGRICULTURAL -1 DISTRICT (UP TO 1 UNIT <br />/5ACRES), AND R, RURAL RESIDENTIAL DISTRICT (UP TO 1 UNIT/ACRE), TO <br />C-1, CONSERVATION -1 DISTRICT (0 UNITS/ACRE); AND <br />C. APPROXIMATELY ± 457.86 ACRES, LOCATED APPROXIMATELY 2 MILES <br />WEST OF INTERSTATE 95 AND APPROXIMATELY 1.5 MILES NORTH OF SR -60, <br />FROM AG -2, AGRICULTURAL -2 DISTRICT (UP TO 1 UNIT/10ACRES), TO C-1, <br />CONSERVATION -1 DISTRICT (0 UNITS/ACRE); <br />AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners adopted the Indian River County Comprehensive <br />Plan on February 13, 1990, and <br />WHEREAS, the County received the subject comprehensive plan amendment application during its <br />July 2009 amendment submittal window, and <br />WHEREAS, the Local Planning Agency held a public hearing on this comprehensive plan amendment <br />request on September 24, 2009, after due public notice, and <br />WHEREAS, the Local Planning Agency voted 5-0 to recommend that the Board of County <br />Commissioners transmit the subject comprehensive plan amendment to the Florida Department of <br />Community Affairs; and <br />WHEREAS, the Board of County Commissioners of Indian River County held a Transmittal Public <br />Hearing on November 3, 2009, after advertising pursuant to F.S. 163.3184(15)(b)(1), and <br />WHEREAS, the Board of County Commissioners approved the transmittal of this comprehensive plan <br />amendment to the Florida Department of Community Affairs with a request for review, and <br />WHEREAS, the Board of County Commissioners announced at the transmittal public hearing its <br />intention to hold and advertise a final public hearing at the adoption stage of this plan amendment, and <br />WHEREAS, the Florida Department of Community Affairs received this Comprehensive Plan <br />F:\Community Development\Comprehensive Plan Land Use Amendments\Conservation Lands July 2009-CPA-261\BCC conservation <br />lands Ordinance march 23.doc <br />1 <br />
