i <br />i <br />i <br />ON MOTION MADE by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, the Board <br />unanimously approved the above minutes, as <br />written. <br />Attorney Brandenburg belatedly called to the Board's <br />attention that in the minutes of the Regular Meeting of <br />February 2, 1983, in the last paragraph on page 37 where <br />Commissioner Fletcher had asked him if we were in our legal <br />right to impose these requirements and conditions at this <br />time, it should read: "that he was assured that the <br />Commission does have the right, although any applicant has <br />the ability to have a matter reviewed in court." <br />Attorney Brandenburg also noted that on page 38 of the <br />same minutes, the motion was incorrectly reported; that it <br />should read: "the Board unanimously approved the <br />preliminary plat approval for Luria's Plaza with the <br />inclusion of all staff recommendations of six conditions <br />P <br />dated January 24:, 1983, with Condition #4 being modified to <br />read, 'recommended that the entrance drive be four lanes -- <br />two lanes <br />,Vn and two lanes out -- '.to be divided by a <br />ten -foot wide, planted median." <br />fi <br />ON MOTION MADE by Commissioner Lyons, <br />SECONDED by Commissioner Scurlock, the <br />Board unanimously agreed to reconsider <br />approval of the Minutes of the Regular <br />Meeting -of 2/2/83. <br />ON MOTION MADE by Commissioner Lyons, <br />SECONDED by Commissioner Scurlock, the <br />Board unanimously approved the Minutes of <br />the Regular Meeting of 2/2/83, as <br />amended by the Attorney. <br />3 is 52'rA2858 <br />MAR 2 1983 <br />
