ORDINANCE NO. 2011-ni n <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA <br />FURTHER EXTENDING THE DEADLINE BY SEVEN (7) YEARS <br />FOR PLANNED DEVELOPMENTS TO COMMENCE <br />CONSTRUCTION OR HAVE THEIR ZONING REVERT TO THE <br />SITE'S ORIGINAL (PRE -PLANNED DEVELOPMENT <br />APPROVAL) ZONING; AND PROVIDING FOR EFFECTIVE <br />DATE. <br />WHEREAS, the Board of County Commissioners of Indian River County <br />had approved four (4) Planned Development projects and included within those <br />approvals is a requirement that the Planned Development zoning approval <br />sunset if project construction did not commence by a certain date; and <br />WHEREAS, one of the four projects is no longer viable due to foreclosure, <br />therefore only three of the four approved projects are the subject of this <br />ordinance; and <br />WHEREAS, due to current economic conditions the Board finds that it is <br />reasonable to further extend those deadlines for an additional seven (7) years; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that the zoning <br />reverter deadlines for construction commencement of the following planned <br />developments be further extended for seven (7) years: <br />Liberty Park PD to October 14, 2025 [revises Ordinance Nos. 2008-017 and <br />2009-020] <br />Turtle Creek Preserve PD to April 4, 2021 [revises Ordinance Nos. 2006-009 <br />and 2009-020] <br />Sunnyside Up PD to January 20, 2029 [revises Ordinance Nos. 2009-001 and <br />2009-020] <br />State. <br />EFFECTIVE DATE. <br />This ordinance shall take effect upon filing with the Florida Department of <br />This ordinance was advertised in the Vero Beach Press -Journal on the <br />28th day of November, 2011, for a public hearing to be held on the 13th day of <br />December, 2011, at which time it was moved for adoption by Commissioner <br />Rn1 ari , seconded by Commissioner Flescher , and adopted <br />by the following vote: <br />
