Goetzfried, REFERENCES: <br />Staff Planner _ <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting on April 6, 1983. <br />DESCRIPTION & CONDITIONS <br />On December 22, 1982, Mr. Robert Neeley representing himself and <br />others, submitted a petition requesting the County to abandon its <br />rights to a portion of 3rd Street, lying between 17th and 18th <br />Avenues as shown on the plat of Indian River Heights Subdivision, <br />Unit 3 (see attachment #2). <br />In accordance with the administrative guidelines approved by the <br />Board of County Commissioners for the processing of right-of-way <br />abandonment applications, the request was reviewed by all County <br />departments and utility providers having jurisdiction within the <br />roadway. <br />In the past-, the road has been maintained by the County. The 70' <br />right-of-way does not provide adequate access nor is it essential <br />to the traffic flow through the subdivision. <br />In an effort to eliminate non -perpendicular lot lines and thereby <br />creating more uniform shaped lots, the four adjacent property <br />owners a4reed to an equitable division of the 3rd Street <br />right-of-way. Each new lot line will lie within a dedicated 20' <br />drainage and utility easement (see attachment #3). It was this <br />proposal that was considered by the reviewing agencies, which <br />included the Department of Public Works, Utilities, Florida Power & <br />Light, and Southern Bell. All responses recommended approval of <br />the request with the condition that drainage and utility easements <br />be retained. If the right-of-way is abandoned, it shall be the <br />responsibility of the property owners to obtain feesimple title to <br />the land as originally agreed upon. This may be accomplished <br />through the recording of the appropriate quit claim deeds. <br />The plat of Indian River Heights subdivision depicts 3rd Street <br />curving to the southeast and ultimately merging with 2nd Street <br />east of 18th Avenue.. Upon the recommendation of the Director of <br />Public Works, -staff is currently reviewing the feasibility of also <br />abandoning the eastern portion of this roadway. <br />ALTERNATIVES & ANALYSIS <br />Vacation of this non-essential roadway will eliminate the County's <br />48 aax 53 4`cE 160 <br />APR 6 1983 <br />
