ORDINANCE NO. 2013- omi <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR f 0.94 ACRES <br />LOCATED ON OLD DIXIE HIGHWAY APPROXIMATELY 700 FEET NORTH OF 65TH <br />STREET, FROM CH, HEAVY COMMERCIAL DISTRICT, TO CL, LIMITED <br />COMMERCIAL DISTRICT; AND PROVIDING CODIFICATION, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency <br />on such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; and <br />WHEREAS, the Board of County Commissioners determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida, that the zoning of the following described property situated in <br />Indian River County, Florida, to -wit: <br />A PARCEL OF LAND LYING IN SECTION 10, TOWNSHIP 32 SOUTH, RANGE 39 EAST, <br />INDIAN RIVER COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS <br />FOLLOWS: <br />COMMENCING AT THE NORTHWEST CORNER OF THE SOUTHWEST QUARTER OF <br />THE NORTHEAST QUARTER OF SECTION 10, TOWNSHIP 32 SOUTH, RANGE 39 <br />EAST, RUN SOUTH 00°10'11" WEST (BASIS OF BEARINGS) ON THE WEST <br />BOUNDARY LINE OF SAID SOUTHWEST QUARTER OF THE NORTHEAST QUARTER, <br />A DISTANCE OF 15.00 FEET TO THE SOUTH RIGHT OF WAY LINE OF 67TH STREET, <br />A VARIABLE WIDTH RIGHT OF WAY; THENCE CONTINUE SOUTH 00°10'11" WEST, A <br />DISTANCE OF 195.00 FEET TO THE SOUTH WEST CORNER OF PARCEL NUMBER <br />32391000000100000038.0 (3435 67TH STREET); THENCE RUN SOUTH 89°44'06"EAST, A <br />DISTANCE OF 412.12 FEET; THENCE RUN NORTH 00°20'36"EAST, A DISTANCE OF <br />Page 1 of 3 <br />
