r <br />ORDINANCE NO. 91- 5 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING LAND USE MAP FROM RM -8, <br />MULTIPLE -FAMILY RESIDENTIAL DISTRICT TO RS -6, SINGLE-FAMILY <br />RESIDENTIAL DISTRICT, FOR THE PROPERTY GENERALLY LOCATED ON <br />THE SOUTH SIDE OF 49TH STREET (LINDSEY ROAD), APPROXIMATELY <br />2700 FEET EAST OF 58TH AVENUE (KINGS HIGHWAY), AND DESCRIBED <br />HEREIN, AND PROVIDING FOR EFFECTIVE DATE.. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County. Commissioners of Indian River <br />County, Florida, did publish and send its Notice ot intento <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that . <br />phi-srezoning is in conformance—with the—Comprehensive Plan of <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE,BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />All of Tract 10, Section 21, Township 32S, Range 39E; less the <br />east 10 acres thereof and excepting therefrom the following <br />described property: Beginning at the northwest corner of said <br />Tract' 10; then southerly along the west line of said Tract 10 <br />a distance of.283.60 feet; thence easterly for a distance of <br />343.53 feet; thence southerly a distance of 283.60 feet to the <br />north line of said Tract 10; thence westerly along the said <br />north line, a distance of 343.53 feet to the point of <br />beginning.
