MOTION WAS MADE by Commissioner Lyons, <br />SECONDED by Commissioner Scurlock, to <br />authorize the Chairman to sign the DER <br />request for waiver of the ninety (90) <br />day time limit. <br />Commissioner Scurlock commented that when we transferred <br />from one DER District to the other, it was indicated we would <br />receive the same level of service; we based our plans on what <br />was approved at that time, and he objected to someone coming in <br />later and changing those rules. In further discussion, it was <br />noted that when we opened our Landfill it was supposed to be a <br />model for the state. <br />Mr. Pinto made the point that these regulations have changed <br />statewide. He explained that what the D.E.R. is doing is trying <br />to anticipate a problem that may occur 10 years down the road <br />when the trash has absorbed as much water as it can and starts to <br />leach out. He believed the D.E.R.'s concerns are the same as <br />ours, and if someone could prove there definitely would be a <br />problem, we would not want to take the risk of polluting the <br />aquifer. That, however, has not been proven so far. <br />Commissioner Scurlock agreed, but stated that it bothers him <br />that because of an idea that is not really provable, they change <br />the rules. <br />Mr. Pinto noted that the DER will present their reasoning <br />for wanting to make these changes at the hearing. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />91 <br />MAY 4 1983 <br />aoa 53 427 <br />r.
