Keating, AICP <br />Planning & Zoning Mgr. <br />RIGHT-OF-WAY ABANDONMENT <br />REQUEST SUBMITTED BY <br />ROBERT PEGG <br />FROM: Mary Jane V.Goetzfried REFERENCES: <br />�IA► Staff Planner <br />Itis recommended that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on May 18, 1983. <br />DESCRIPTION & CONDITIONS <br />On January 17, 1983, -Attorney Robert Pegg submitted a <br />right -of -way -abandonment petition on behalf of tenants in <br />common Dena Lysne Rockey, Lynn Ann Lysne, William E..Orth, Jr., <br />and James Orth. (See Attachment #1.) The application requests <br />the County to abandon its rights to that portion of 17th Street <br />lying between 43rd and 44th Avenues. (See Attachment #2.) <br />In accordance with the administrative guidelines approved by the <br />Board of County Commissioners for the processing of right-of-way <br />abandonment applications, the request was reviewed by all County <br />departments and utility providers having jurisdiction within the <br />roadway. <br />,The 50' right-of-way is not through street and has never been <br />maintained by the County; however, it is the location of a major <br />feeder line providing electrical service from the City of Vero <br />Beach. <br />The right-of-way lies within an 8 acre parcel owned by the <br />aforementioned tenants-in-common, who intend to subdivide the <br />property into four (4) equal sections with individual ownership. <br />In accordance with Ordinance 75-3 this action will require the <br />submittal of a subdivision application and final plat approval <br />prior to the conveyance of title. <br />The Comprehensive Plan designates 43rd Avenue as a primary <br />collector, where access should be well controlled and limited to <br />secondary and major generators. The elimination of this <br />potential access point would be in keeping with the intent of <br />the Plan. Additionally, one.of the items that will be taken <br />into consideration at the subdivision level is the principal <br />means of access for the individual lots. The applicant will be <br />encouraged to create a non -access easement along 43rd Avenue, <br />thereby designating 44th Avenue as the only means of access for <br />any new construction. <br />26 <br />
