Section 1983 of the United States Code which would supply <br />counties and county commissioners with a good faith defense <br />to a 1983 liability action, as well as limiting the awarding <br />of attorney fees as part of the remedy in those actions. <br />Attorney Brandenburg advised that there would be no <br />cost to the County; that they are really requesting, more or <br />less, a resolution by this Board to write our congressmen <br />asking them to support changing this bill. <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Wodtke, the <br />Board unanimously authorized the County <br />Attorney to draft a resolution�as <br />discussed above to be presented at <br />the next meeting. <br />ADOPTION OF RESOLUTION 83-40 - ACQUISITION OF RIGHT-OF-WAY <br />FOR 16TH STREET IMPROVEMENT PROJECT <br />MOTION WAS MADE by Commissioner Scurlock, <br />SECONDED by Commissioner Bowman, that the <br />Board adopt Resolution 83-40 for the <br />acquisition of certain parcels of property <br />for right-of-way purposes for the 16th St. <br />roadway improvement project. <br />Attorney .Brandenburg noted that the Board had approved <br />the Public Works Department recommendation to delete a <br />10 -ft. wide path down there and change it to a smaller size <br />path, eliminating the need to acquire 10 feet. The County <br />will now only have to acquire 5 feet from 24 parcels and <br />also a little bit more around some of the corner parcels. <br />26 <br />JUN 1 1983 690K 3 Act � <br />
