0 .. <br />9/99reso.exchg/Ok <br />RESOLUTION NO. 99 -log <br />A RESOLUTION OF INDIAN RIVER COUNTY, AUTHORIZING <br />THE EXCHANGE OF COUNTY PROPERTY FOR RIGHT OF <br />WAY. <br />WHEREAS, Indian River County is the owner of a parcel of land on Fourth Street, east of Old <br />Dixie Highway, legally described on Exhibit "A" attached to the County Deed conveying the County parcel; <br />and <br />WHEREAS, Richard D. King, a private party, is the owner of a parcel of land south of Fourth <br />Street, adjacent to and south of the County's parcel, legally described on Exhibit "A" attached to the <br />Statutory Warranty Deed conveying the right of way; and <br />WHEREAS, it would be in the mutual benefit of both the County and Richard King to exchange <br />title to these pieces of property to facilitate the drainage improvements for the Fourth Street improvement <br />project; and <br />WHEREAS, Section 125.37, Florida Statutes, allows such an exchange of County land when it is <br />in the public interest and after notice has been published once a week for two weeks; and <br />WHEREAS, notice of this proposed exchange was published twice in the Vero Beach Press <br />Journal, once on Thursday, September 23, 1999, and Thursday, September 30, 1999. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS that: <br />1. The County is authorized to effect the exchange of the parcels as described in this resolution. <br />2. The Chairman of the Board is authorized to execute a County Deed for the County -owned parcel. <br />The resolution was moved for adoption by Commissioner Adams , and the motion was <br />seconded by Commissioner Ginn , and, upon being put to a vote, the vote was as follows: <br />Chairman Kenneth R. Macht <br />Aye <br />Vice Chairman Fran B. Adams <br />Aye <br />Commissioner Caroline D. Ginn <br />Aye <br />Commissioner John W.
