Providing (First Resolution) 3/25/97(ENG)RESI .MAG\ktp <br />RESOLUTION NO. 99- 20 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />PROVIDING FOR CERTAIN PAVING AND DRAINAGE <br />IMPROVEMENTS TO 1ST STREET BETWEEN 161" AVENUE <br />AND 1877 AVENUE (MORELAND SUBDIVISION), PROVIDING <br />THE TOTAL ESTIMATED COST, METHOD OF PAYMENT OF <br />ASSESSMENTS, NUMBER OF ANNUAL INSTALLMENTS, <br />AND LEGAL DESCRIPTION OF THE AREA SPECIFICALLY <br />BENEFITTED. <br />WHEREAS, the County Public Works Department has been petitioned for Road <br />Paving and Drainage Improvement for 1" Street between 16'h Avenue and 18'h Avenue. <br />WHEREAS, the construction of paving and drainage improvements by special <br />assessment funding is authorized by Chapter 206, Section 206.01 through 206.09, Indian River <br />County Code; and cost estimates and preliminary assessment rolls have been completed by the Public <br />Works Department; and the total estitnated cost of the proposed paving and drainage improvements <br />is TWENTY-SIX THOUSAND SEVEN HUNDRED FIFTY SIX DOLLARS and ONE CENTS <br />($26,756.01); and <br />WHEREAS, the special assessment provided hereunder shall, for any given record <br />owner of property within the area specially benefitted, be in an amount equal to that proportion of <br />seventy-five percent (75%) of the total cost of the project ($20,067.01) which the number of lineal <br />feet of road frontage owned by the given owner bears to the total number of lineal feet of road <br />frontage within the areas specially benefitted plus two percent (2%) of the property owners <br />assessment for collection fees and twenty-five percent (25%) of the total cost of the project <br />($6,689.00) will come from Petition Paving Account. Assessments are to be levied against all Tots <br />and lands adjoining and contiguous or bounding and abutting upon the improvements or specially <br />benefitted thereby and further designated by the assessment plat with respect to the special <br />assessments; and <br />WHEREAS, the special assessment shall become due and payable at the Indian River <br />County Utility Services Department ninety (90) days after the final determination of the special <br />assessment pursuant to Section 206.08, Indian River County Code; and <br />A:9721 Res-Providing-mag.v.pd 1 <br />
