AUG 3 1983 <br />Bob Keating, Planning & Zoning Manager, gave a brief <br />summary of Mr. Beatty's application for an after the fact <br />permit to build a six-foot, front yard fence and a six-foot <br />fence surrounding the remainder of this property. The <br />Planning & Zoning Commission addressed the Beatty minor site <br />plan application on June 23, 1983. At that time, Mr. Beatty <br />presented additional information and stated that the primary <br />purpose for the fence is safety, to protect his children <br />from dogs running loose in the neighborhood. Mr. Keating <br />reported that the Planning and Zoning Commission had denied <br />Mr. Beatty's request for approval of a six-foot cedar fence <br />surrounding his property. The reason for denial was visual <br />incompatibility of the fence with the surrounding area. <br />Mr. Keating informed the Board that since the denial, <br />there has been another dog incident in the neighborhood and <br />Mr. Beatty has notified the Sheriff's Dept. It is still the <br />recommendation of staff, however, to deny the appeal. He <br />`advised that'Mr.' Beatty does have an alternative of putting <br />up a fence around his property as long as it conforms with <br />the requirements of the Zoning Code that the fence not <br />exceed 3 feet in height in the front yard, 5 feet on the <br />sides and 6 feet in the rear yard. <br />Mr. Beatty, 1486 Pelican Lane, addressed the Board and <br />pointed out that there were three homes in Pelican Cove <br />where the front yard fences exceed 4 feet, which is contrary <br />to the ordinance as written. <br />Mr. Beatty felt the real issue is whether the <br />Commission is going to let the arbitrary fence limitation <br />interfere with the safety and the protection of his family. <br />He felt that one wouldn't know what the real issue is by <br />reading the article in Tuesday's edition of the Press <br />Journal or by reading the analysis and recommendations and <br />the extracts from the Planning & Zoning Commission meeting <br />42 <br />
