AUG 17 1983 <br />PAGE <br />fl <br />1 <br />l <br />Assistant County Attorney Chris Paull reviewed the <br />history of the proposed Tree Ordinance noting that it has <br />been completely rewritten since it was first considered by <br />the Planning & Zoning Commission in 1981, at which time <br />there were a number of problems. The Ordinance as now <br />proposed addresses four major areas: <br />1) protection of trees, <br />2) permitting process for land clearing, <br />3) protection of mangroves, and <br />4) protection of the dune system and dune vegetation. <br />With respect to Item 4, Attorney Paull explained that <br />this will establish a local coastal construction setback <br />line, which is not necessarily the same as the one <br />established by the Department of Natural Resources. While <br />the DNR can issue a variance allowing someone to build <br />seaward of their line, they do give precedence to local <br />requirements. The Attorney further reported that the <br />Ordinance will be administered through the Community <br />Development Division, and he believed Mr. Challacombe will <br />serve as the Environmental Administrator. Mr. Paull <br />continued that a number of comments have been received <br />recently, which he has set out in a memo dated August 10, <br />1983, and he would request that the Board review this before <br />any final decision is made on the Ordinance. William <br />Bidlingmayer, an authority on Florida flora, has also <br />offered some suggestions, and both these memos are as <br />follows: <br />71 <br />
