A 1. l r 17 1983 PAU 30 <br />Responsibility Act of 1982, the County will have to publish <br />again 14 days in advance of putting this on the agenda. <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, the Board <br />unanimously postponed discussion of the Florida <br />Health Facilities Project until the meeting of <br />September 7, 1983, when it will be placed on <br />the agenda as a time certain item. <br />DISCUSSION RE REQUIREMENTS OF SUNSHINE LAW RELATIVE TO <br />COUNTY COMMISSION WORKSHOP AND SPECIAL CALL MEETINGS <br />The Board reviewed the following memo dated 8/9/83: <br />TO. Members of the DATE: August 9, 1983 FILE: <br />Board of County Commissioners <br />SUBJECT: Special Call Meetings of <br />the Board of County <br />Commissioners and Special <br />Call Workshop Meetings <br />FROM: Gary M. Brandenburg REFERENCES: <br />County Attorney <br />Recently members of the press have indicated to me a certain <br />dissatisfaction with what they consider too short advance notice of <br />Special Call Meetings. I would recommend that the County <br />Commission establish a firm policy on the timing and.notice <br />required to be given in the event a Special Call Meeting is <br />necessary in the future. <br />The Sunshine Law requires that reasonable notice of the time, place <br />and subject matter of a meeting be given to members'of the public <br />in advance of the meeting. This is necessary because public <br />participation cannot occur if the public does not know the time, <br />place and subject matter in advance. The question that always <br />arises with respect to a Special Call Meeting is what constitutes <br />reasonable advance notice. Obviously, reasonableness must be <br />judged in relation to the type, extent and importance of the <br />emergency that requires a meeting. I would recommend that the <br />County adopt a policy requiring the time, place and subject matter <br />of the meeting be distributed to the general public via the media <br />for all Special Call Meetings as soon as possible but not less than <br />forty-eight (48) hours in advance unless the emergency is such that <br />action is required sooner to protect County or public resources. <br />Furthermore, I would recommend that staff be instructed to give <br />notice as soon as it becomes apparent that a meeting is necessary. <br />The policy being that it is better to give more advance notice and <br />then cancel the meeting if it proves not to be necessary than to <br />give an inadequate notice. <br />44 <br />
