<br />GENERAL RELEASE
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That we, THE BOARD OF COMMISSIONERS OF INDIAN RIVER COUNTY,
<br />FLORIDA, first party, for and in consideration of being released
<br />from all liability, to the same extent as set forth herein, or
<br />other valuable considerations, received from or on behalf of
<br />REINHOLD CONSTRUCTION, INC., its predecessors, assigns and suc-
<br />cessors in interest, second party, the receipt of which is hereby
<br />acknowledged, (Whereever used herein the. terms "first party" and
<br />"second party" shall include signular and plural, heirs, legal
<br />representatives, and assigns of individuals, and the successors
<br />and assigns of corporations, whereever the context so admits or
<br />requires.)
<br />HEREBY remise, release, acquit, satisfy, and forever dis-
<br />charge the said second party, of and from all, and all manner of
<br />action and actions, cause and causes of action, suits, debts,
<br />dues, sums of money, accounts, reckonings, bonds, bills, spe-
<br />cialties, covenants, contracts, controversies, agreements, promi-
<br />ses, variances, trespasses, damages, judgments, executions,
<br />claims and demands whatsoever, in law or in equity, which said
<br />first party ever had, now has, or which any personal represen-
<br />tative, successor, heir or assign of said first party, hereafter
<br />can, shall or may have, against the second party, for, upon or by
<br />reason of any matter, cause or thing whatsoever, from the
<br />beginning of the world to the day of these presents, for all
<br />those matters arising out of the design, construction and/oz
<br />renovation of the projects known as the Indian River County
<br />Administration Bldg., Indian River County Courthouse and
<br />Courthouse Annex, and/or the subject matter of that litigation
<br />entitled Reinhold Construction, Inc. v. The Board of Indian River
<br />County v. Connell, Metcalf & Eddy, Inc., in the 19th Judicial -
<br />Circuit, Indian River County, Florida, Case No. 81-788, including
<br />but not limited to the following: (l) --fire rated drywall
