not be considered until a rate hearing has been conducted at <br />a time to be set by the Board. <br />Chairman Bird reported that the Moorings Property <br />Owners Association has indicated they could be ready to <br />present their case in October or November, and Mr. White <br />confirmed that October 15th would be satisfactory. <br />Beard members had questions about what was being <br />required of Hutchinson Utilities by the DER, and Tom Vaughn <br />of Hutchinson Utilities informed the Board that the plant <br />does have to be upgraded to meet DER regulations; it needs <br />extensive work; and it will have to be relocated as the site <br />is not adequate.. <br />Commissioner Scurlock noted that there seem to be some <br />differences of opinion as to the need for the plant site <br />relocation, the requirement for additional capacity, etc., <br />and felt there should be a meeting of all parties involved <br />The Moorings Development Company, Hutchinson Utilities, the <br />Moorings Property Owners Association, etc. <br />Mr. Vaughn believed that while there are different <br />views and some points can be argued, the main point is that <br />the DER does control what the utility can do, and Hutchinson <br />Utilities falls under the same regulations as everyone else. <br />If they don't meet the new standards, the DER will not renew <br />their temporary permit, which will, be reviewed and expire <br />next June. Since they do not own the property on which the <br />facility is presently located,,and also since there is not <br />enough room at this location to accommodate the required <br />improvements, Mr. Vaughn stressed that it will be necessary <br />to relocate the facility. <br />Dorothy Hudson, Attorney for the Moorings Development <br />Co., confirmed that the plant in question, which actually is <br />part of a tandem plant, is ten years old and it is not in <br />good condition; serious improvements are needed.
