Pegg <br />It is requested that the data herein presented be given <br />formal consideration by the Board of County Commissioners at <br />their regular meeting on September 7, 1933. <br />DESCRIPTION & CONDITIONS <br />On January 17, 1983, Attorney Robert Pegg submitted a <br />right-of-way abandonment petition on behalf of tenants-in- <br />common Dena Lysne Rockey, Lynn Ann Lysne, William E. Orth, <br />Jr., and James Orth. (See Attachment #1) The application <br />requests the County to abandon its rights to that portion of. <br />17th Street lying between 43rd and 44th Avenues. (See <br />Attachment #2) <br />In accordance with the administrative guidelines approved by <br />the. Board of County Commissioners for the processing of <br />right-of-way abandonment applications, the request was <br />reviewed by all County departments and utility providers <br />having jurisdiction within the roadway. <br />The 50 foot right-of-way is <br />never been maintained by the <br />location of a major feeder 1 <br />from the City of Vero Beach. <br />not a through street and has <br />County; however, it is the <br />ine providing electrical service <br />The Comprehensive Plan designates.43rd Avenue as a primary <br />collector, where access should be well controlled and limited <br />to secondary and major generators. The elimination of this <br />potential access point would be in keeping with the intent of <br />the Plan. The applicant is encouraged to create anon -access <br />easement along 43rd Avenue, thereby designating 44th Avenue <br />as the only means of access for any new construction. <br />In May of 1983, the Board of County Commissioners held a <br />public hearing to consider the aforementioned request. At <br />that time, staff was directed to investigate the feasibility <br />of relocating the electrical service line or reducing the <br />size of the encumbered property. <br />32 <br />
