PW <br />UTILITY SERVICE AREA DECLARATION FOR LAUREL BUILDERS, INC., <br />SEAGLE DEVELOPMENT CO., INC., CARWASH WEST, AND ALBERTSON'S <br />Commissioner Scurlock explained that earlier in the <br />meeting the Board had voted to table this item, but he had <br />noticed that Mr. Robinson is now in attendance and perhaps <br />this item could be discussed now. <br />Mr. Robinson, representing Laurel Builders, summarized <br />the problem that Laurel Builders and Seagle Development Co. <br />have.had in obtaining water and sewer service. He explained <br />that Laurel Builders want to go ahead with the development, <br />but are in limbo because of the sewer service. They are <br />surrounded on both sides by City sewer in that location and <br />he felt that if the County wants a franchise on that <br />property, it might be opening a can of worms. <br />Commissioner Scurlock explained that we have asked for <br />the Attorney General's opinion as to the legal ability to <br />have an unincorporated area of the County served by the City <br />of Vero Beach. <br />Commissioner Wodtke felt that if we are going to <br />discuss this matter now, we should have a motion to take it <br />off the table. He explained that he had voted against <br />tabling it earlier because he wanted some discussion to take <br />place. <br />ON MOTION by Commissioner Lyons, <br />SECONDED by Commissioner Scurlock, the <br />Board unanimously replaced this item on <br />today's agenda. <br />After considerable discussion, Attorney Brandenburg <br />advised the Board that they could go ahead and approve these <br />declarations today and add some language that the County is <br />not waiving any rights to place a franchise fee on areas in <br />the County being served by the City of Vero Beach. <br />67 <br />
