Manager <br />FROM:Art Challacoe <br />EnvironmentalbPlanner REFERENCES: DINDIAN LAKES <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on September 21, 1983. <br />DESCRIPTION & CONDITIONS <br />On July 6, 1983, Mr. Michael O'Haire, representing the Hobart <br />Landing Property Owners Association, submitted a letter <br />stating that the Indian Lakes Condominium site plan "should be <br />deemed terminated and the developer notified accordingly." <br />Staff reviewed the matter and in a memorandum dated July 25, <br />1983, developed a brief chronology of events, including a <br />point -by -point determination that the site plan approval was <br />still valid due to a commencement of construction. <br />Mr. O'Haire, in a letter dated August 29, 1983, stated it was <br />his belief that site plan approval and building permit ap- <br />proval should lapse when the zoning permit lapses. It is that <br />issue which is addressed in this analysis. <br />ALTERNATIVES & ANALYSIS <br />Section 23(h) of the Indian River County Zoning Ordinance <br />states that site plan approval shall terminate twelve (12) <br />months after its issuance if construction has not started. <br />The Ordinance also states that the Board of County <br />Commissioners may grant extensions of time at its discretion. <br />In this case, the Board granted a six month extension of the <br />Indian Lakes Condominium site plan on July 7, 1982 to commence <br />on July 23, 1982. This extension would be valid until January <br />23, 1983. In the meantime, the developer installed the first <br />building foundation and received conformation from the <br />Community Development Division that commencement of <br />construction had begun. On September 12, 1983, the Community <br />Development Division received oral conformation from the <br />Building Department that the building permit for. Indian Lakes <br />Condominum was still valid. <br />106 <br />
