fie pointed out that the density has dropped from the <br />original 15 to 11 and now to 6. <br />Attorney Brandenburg noted that the ordinance does <br />allow a height of 35'in R -2D, but as part of Site Plan <br />Approval, it would be possible to include building height <br />restrictions due to special circumstances in the <br />neighborhood. <br />Attorney O'Haire requested as a procedural matter, <br />since there has been a transfer, that the existing site plan <br />be declared void.. <br />Commissioner Scurlock believed that can be taken care <br />of at the same time as the rezoning. <br />Attorney O'Neill confirmed that his client is willing <br />to cooperate fully and he will be glad to go to 6 units per <br />acre, but he did not want to waive rights under the site <br />plan, which he believed is still valid. <br />Chairman Bird stated that his legal position is duly <br />noted. <br />ON MOTION by Commissioner. Scurlock, SECONDED <br />by Commissioner Lyons, the Board unanimously <br />closed the public hearing. <br />MOTION WAS MADE by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, to initiate <br />a downzoning of the subject Indian Lakes Condo- <br />minium, property to.
