I <br />DESCRIPTION & CONDITIONS <br />r <br />The County has been petitioned by Robert Woods, owner of the <br />subject property, for release of the six (6) foot utility <br />and drainage easement, being the north 3 feet of Lot.3, <br />Block 9 and the south 3 feet of Lot.2, Block 9, Kings <br />Highland Subdivision.. Lot 3 is 70 feet in width and 129.77 <br />feet in depth Lot 2 is 70 feet in width and 129.77 feet in <br />depth. It is Mr. Wood's intention to consolidate the two <br />lots, thereby resolving the problem of encroachment of the <br />easement by the existing residence which was constructed <br />over the center lot line of the two lots. <br />The current zoning classification is R-1, Single -Family <br />Residential. The land use designation is MXD, Mixed Use <br />District, 14 units/acre. <br />ALTERNATIVES `& ANALYSIS <br />The request has been reviewed by Southern Bell, Florida <br />Power & Light Company, Florida Cablevision, Inc., and the <br />Indian River County Utility and Right -of -Way Departments. <br />Based upon their reviews, there are no objections to release <br />of the easement. The zoning staff analysis, which included <br />a site visit, showed that drainage would be adequately <br />handled by the existing front, rear and side swales. <br />It is the zoning department's opinion that to release the <br />common side lot 3 foot easement of Lots 2 & 3, Block 9, <br />Kings Highland Subdivision would create no adverse effects. <br />RECOMMENDATION <br />Staff recommends to the Board, through adoption of a resolu- <br />tion, the release of the common side lot 3 foot easement of <br />Lots 2 & 3, Block 9, Kings Highland Subdivision, <br />S E P 211983 <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Bowman, the Board <br />unanimously adopted Resolution 83-73 releasing <br />those common side lot 3 -foot easements.on Lots <br />2 & 3, Block 9, Kings Highland Subdivision, as <br />requested by Robert Woods. <br />13 <br />5 Pr <br />a rka6 9 <br />J <br />
