P APPROVAL <br />Planning & Zoning Manager <br />Karen.Craver l <br />FROM: Planning Tech i ian REFERENCES: <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of September 21, 1983. <br />DESCRIPTION AND CONDITIONS <br />On April 7, 1983, Jerry O'Connell was issued a zoning permit to <br />place a 6 foot high shadowbox fence along the rear property <br />line of his lot located at the southwest corner of 2nd Street <br />and 16th Avenue. At the time of placement of the permitted <br />fence, a section of identical fence, for which a permit was not <br />issued, was located along the front property line facing 2nd <br />Street. As the result of a complaint by a neighbor, <br />Mr. O'Connell submitted a minor site plan request, and the <br />matter was placed on the August ll, 1983, agenda.of the <br />Planning and Zo?;ing Commission in order to receive <br />after -the -fact approval of the portion of fence for which a <br />permit had not been issued. <br />Because the zoning code states that on corner lots all yards <br />which abut the street are considered front yards, the O'Connell <br />site plan application requested a deviation of three feet, from <br />the 3 foot height limitation for front yard fences as specified <br />in Section 25 (i)(1) of the zoning code to the six (6) foot <br />height proposed. The Planning and Zoning Commission approved <br />the fence provided that it be relocated and set back twenty <br />(20) feet from the property line, putting the fence in the <br />buildable area and making the fence applicable to the five foot <br />height limitation for side yard fences. It is the condition of <br />this approval that Mr. O'Connell is appealing to the Board of <br />County Commissioners. <br />ALTERNATIVES AND ANALYSIS <br />The O'Connell residence is located on a corner lot within the <br />R-1, Single -Family Residential, zoning district and thereby has <br />91 <br />SEP 211983 600K 54 FACE 699 <br />
