LEASE OF TWO COUNTY LOTS TO BETHEL A.M.E. CHURCH <br />The Board reviewed the following memo dated 10/11/83: <br />TO. Church of <br />-- Indian River County,.Inc. <br />FROM: Gary M. Brandenburg REFERENCES: <br />County Attorney <br />The Board of County Commissioners of Indian River County previously <br />received the request of Rev. Jackson on behalf of the Bethel A.M.E. <br />Church of Indian River County, Inc. for the use of two lots <br />abutting their current church site. The Church proposes to use <br />these two lots to construct a new facility. <br />Under the provisions of Florida Statutes §125.38 the County may <br />determine that certain properties are not needed for County <br />purposes and therefore eligible for use by other governmental <br />organizations and not-for-profit corporations organized for the <br />betterment of the community. In this case, the County does not <br />have to place the properties out for bid and may negotiate a lease <br />or conveyance of the property at any value it sees fit regardless <br />of the actual value of the property in question. <br />Attached to this memorandum you will find a 99 -year lease agreement <br />between the County and the Church providing for the rental of $1.00 <br />per year for a total of $99.00 payable in advance. Once this lease <br />is executed, the Church will have total responsibility for the site <br />and agrees to hold the County harmless from any liability arising <br />from their use of the site. I have included a provision <br />automatically terminating the lease if the Lessee should ever use <br />the premises for anything other than church and associated purposes <br />or should the Lessee abandon use of the site as a church facility <br />for a continuous period of six months after the initial <br />construction phase. As an additional safeguard, I have included a <br />provision providing for the automatic termination of the lease if <br />construction of a new facility is not commenced on the site within <br />a 3 -year period after execution of the agreement. <br />Please review the agreement and all of its terms and indicate what <br />modifications, if any, are necessary to make it consistent with the <br />County Commission's intent. I have provided Rev.
