I <br />NOV 21993 800 55 . t�AU 2 2 <br />for irrigation usage, and if 100,000 gallons of effluent <br />were put on the ground for irrigation, the 20 condos would <br />pay a pro rata share equally of that 100,000 gallons. <br />Commissioner Lyons understood that, but asked if this <br />was stated any place in the franchise. <br />Attorney Brandenburg agreed this should be clarified <br />and felt he and Attorney Henderson could work it out <br />together. <br />Commissioner Scurlock asked whether there will be one <br />condominium association or several, and Attorney Henderson <br />noted that the only one in existence at this time is Baytree <br />Property Owners, but he does not know what there may be in <br />the future. <br />Commissioner Scurlock wished to make sure that <br />developers applying for these franchises consider themselves <br />as a true utility from the beginning and develop a rate <br />structure that will provide a fair rate of return so that, <br />as development takes place, they do not have to come back to <br />the Commission asking for a 300% rate increase because they - <br />have been subsidizing the utility operation. <br />Attorney Henderson informed the Board that a lot of <br />base data has been submitted to the Utility Department <br />justifying the rate, and Director Pinto confirmed that they <br />did a computer analysis out to the build -out of the project <br />basing the rate on the revenue needs; the operation cost <br />prior to development of the project will be covered by <br />paying the rate. <br />Commissioner Scurlock noted that he -just wanted to get <br />this set out in the record so that a few years down the road <br />it is very clear as to what was stated today. <br />Mr. Wohlfarth discussed unit rates vs. a flat rate, and <br />noted that in the case of this particular project being a <br />somewhat seasonal project, they went.ahead and raised the <br />flat rates up a little higher because they felt that the <br />65 <br />
