Attorney Brandenburg stated that Section 4 has been <br />changed to restrict the size of the territory. Section 17 <br />a. changes some of the time frames and procedures in regard <br />to requesting rate increases, and this changes are agreeable <br />to GDU. <br />If GDU-should enter into a water purchase agreement <br />with the County, Section 17 b. provides that any subsequent <br />increases in the county rates could be passed on to their <br />customers without an additional hearing. In other words, <br />what would be passed through would be the total increase of <br />cost to the utility. <br />Mr. Fancher confirmed that the intent would be to leave <br />the utility in the same profit position as they were before. <br />Attorney Brandenburg noted that Sec. 23 imposes a 60 <br />franchise fee, which is commonplace in modern franchises, <br />and this comprises all the changes. <br />Chairman Bird inquired about the extent the territory <br />is being changed by the boundaries being adjusted, and it <br />was noted that this basically shrinks the area and brings it <br />in line with GDU's own development. It has no effect on <br />4 - <br />existing residents. <br />Chairman Bird asked if anyone present wished to be <br />heard.
