ON MOTION by Commissioner Scurlock, SECONDED <br />by Commissioner Bowman, the Board unanimously <br />closed the public hearing. <br />MOTION.WAS MADE by Commissioner Scurlock, <br />SECONDED by Commissioner Bowman, to adopt <br />Ordinance 83-41 (the Tree Ordinance), in- <br />cluding changes made to Sec. 11. <br />Attorney Brandenburg noted that the way Sec. 3 - <br />Applicability - is written, it is applicable countywide, <br />including within municipal boundaries. He wished to know if <br />this has been coordinated with any of the municipalities. <br />Attorney Paull stated that it has been addressed with <br />some of the municipalities, but not all. He noted that if a <br />city does not want to be governed by this ordinance, they <br />have the ability to adopt their own ordinance. <br />Attorney Brandenburg recommended that the Board make <br />the ordinance applicable only in the unincorporated area and <br />send a copy to each of the municipalities, asking them to <br />consider adoption of it. <br />COMMISSIONERS SCURLOCK AND BOWMAN reworded their <br />Motion to adopt Ordinance 83-41 including the Changes <br />to Sec.11 and further modification to Sec.3 as re- <br />commended by the Attorney. <br />Commissioner Wodtke discussed the fact that one acre <br />lot subdivisions are exempt except at the time the original <br />subdivider plats the property, and Attorney Paull confirmed <br />that when the original subdivider lays out his streets, <br />easements, etc., he would have to obtain a tree removal <br />permit if he wished to remove any protected trees. <br />94 <br />Nov 16 1983 <br />I <br />
