4. The Attorney shall act as the legal adviser to the <br />Board of County Commissioners of Indian River County according to <br />the terms of Section 1-35 (Ordinance No. 82-10 Section 5, 6-2-82) <br />of the Code of Laws and Ordinances of Indian River County. <br />5. This employment contract may be terminated by the <br />County only for cause according to the procedures set forth in <br />Section 1-33 (Ordinance No. 82-10 Section 3, 6-2-82) of the Code <br />of Laws and Ordinances of Indian River County or in accordance <br />with paragraph 6 hereof. Failure to diligently and conscien- <br />tiously discharge the duties of the office of County Attorney <br />shall constitute just cause for termination under this paragraph. <br />Should the County terminate Attorney under this <br />paragraph, he shall be entitled to severance pay calculated based <br />upon Attorney's salary at the date of termination according to the <br />following table and years of service: <br />Years of Service <br />2 or less <br />3 <br />4 <br />5 or more <br />Severance Pay <br />60 days <br />90 days <br />120 days <br />150 days <br />Attorney shall also be entitled to pay for all <br />accrued vacation time and sick leave according to the regulations <br />set forth in the Indian River County Rules and Regulations for the <br />Personnel Management System for administrative employees. <br />6. This employment contract may also be terminated by <br />the County at the end of the initial term or any subsequent yearly <br />extension thereof by giving the Attorney sixty (6 0) days written <br />notice in advance of the end of the initial term or yearly exten- <br />sion, whichever is applicable, in which event Attorney shall be <br />entitled to severance pay in accordance with the schedule in para- <br />graph 5 hereof. This employment contract may be terminated by the <br />Attorney at the end of the initial term or any subsequent yearly <br />extension thereof by giving the County sixty (60) days written <br />notice in advance of the end of the initial term or subsequent <br />extension, in which event Attorney shall not be entitled to any <br />severance pay. <br />DEC -71993 -2- a� �� <br />L <br />
